TRAVDIF TERMS AND CONDITIONS

Welcome to Travdif! These Terms and Conditions ("Terms") govern your use of our website, services, and travel experiences. By accessing or using Travdif’s platform, mobile site, or booking services, you agree to comply with and be legally bound by the following detailed Terms and Conditions.

Please read them carefully before proceeding.

1. Applicability

These Terms and Conditions apply to all users of Travdif, whether you are a visitor, a registered user, or a customer engaging in our travel services, website browsing, booking customized trips, contacting us for information, or participating in promotions.

They govern:

  • Access to our platform
  • Usage of travel consultation and guidance services
  • Participation in trips organized or coordinated through Travdif
  • Any communication or transactions conducted through Travdif’s websites, mobile apps, or direct channels (email, phone, WhatsApp, etc.)

Travdif may, at any time and without prior notice, modify these Terms. Updated versions will be published on our website. Continued use of the platform after any modification constitutes acceptance of the new Terms.

2. Eligibility to Use

You affirm that:

  • You are at least 18 years of age and legally capable of entering into binding contracts.
  • If you are under 18, your parent or guardian must accompany you on the trip and must assume full responsibility for your participation.

Travdif reserves the right to restrict access to any user who:

  • Provides inaccurate, false, or misleading information.
  • Violates applicable laws or these Terms.
  • Attempts to undermine or misuse Travdif’s services.

3. Content and Website Usage

All intellectual property, including logos, service marks, content, images, trip descriptions, itineraries, designs, illustrations, videos, and written content on Travdif’s platform, are owned, licensed, or controlled by Travdif.

You may:

  • View and access the content for personal, non-commercial purposes. You may NOT:
  • Copy, reproduce, modify, publish, distribute, or exploit any material without explicit written consent from Travdif.
  • Use automated systems to scrape or extract content.
  • Misrepresent the content as your own.

Misuse of content could lead to termination of access, legal action, or both.

4. Liability of Travdif

Travdif acts as an independent travel service provider.

While we take every reasonable effort to deliver safe, enjoyable, and accurate experiences, Travdif is not responsible for:

  • Personal injuries, accidents, or health-related issues occurring during travel.
  • Loss or theft of personal belongings.
  • Delays, changes, or cancellation of services due to external factors including but not limited to:
    • Weather conditions
    • Natural disasters
    • Political unrest
    • Public health emergencies (e.g., pandemics)
    • Supplier issues (e.g., hotel closures, transportation strikes)
  • Third-party negligence or misconduct during activities booked through Travdif.

Travdif limits its liability to the cost of the service paid by the user unless otherwise specified by applicable law.

5. User’s Responsibility

All users must:

  • Provide truthful, complete, and updated information during the booking process.
  • Obtain necessary travel documentation (passports, visas, vaccination certificates, insurance papers).
  • Understand and comply with local laws, customs, and regulations.
  • Respect cultural sensitivities, nature reserves, heritage sites, and communities we visit.
  • Follow safety protocols and instructions provided by Travdif’s representatives or local partners.
  • Maintain polite and respectful behavior toward fellow travelers, hosts, vendors, and communities.

Non-compliance may result in removal from the trip without refund.

6. Security and Account-Related Information

You are responsible for safeguarding the confidentiality of your personal information shared with Travdif.

You agree to:

  • Notify Travdif immediately of any unauthorized use of your data.
  • Ensure that your contact information is accurate to receive timely trip updates and communication.

Travdif is not responsible for any loss or damage resulting from your failure to secure your account or mobile device.

7. Fees and Payment

All fees related to trips, services, or products provided by Travdif must be paid as outlined at the time of booking.

  • Payment Terms: 100% advance payment required before trip commencement.
  • Payment Modes: UPI, credit cards, debit cards, NEFT, IMPS, or other methods specified.
  • Currency: All payments are accepted in Indian Rupees (INR) unless otherwise specified.
  • Late Payments: Delayed payments may result in booking cancellation without refund.

Any additional or unforeseen charges (e.g., changes in government tax, entry fees, or surcharges) must be borne by the traveler unless agreed otherwise.

8. Usage of Mobile Number and Communication Details

By submitting your contact information:

  • You authorize Travdif to communicate with you for purposes related to trip planning, customer service, updates, and promotions.
  • Communications may be through call, SMS, email, WhatsApp, or in-app notifications.
  • Travdif respects your privacy and will not sell, rent, or disclose your information without consent unless required by law.

You can opt-out of promotional communications anytime by notifying us.

9. Insurance

Travdif highly recommends that users purchase comprehensive travel insurance covering:

  • Medical emergencies
  • Trip cancellation and interruptions
  • Baggage loss
  • Accident and injury

Travdif is not an insurance provider and is not liable for claims, denials, or disputes arising with insurance companies.

You are solely responsible for purchasing and maintaining insurance coverage.

10. TCS Compliance

As per Section 206C(1G) of the Income Tax Act, 1961, Travdif may be required to collect Tax Collected at Source (TCS) on international travel packages.

If applicable:

  • TCS will be collected at the prescribed rate (currently 5% or any updated rate) in addition to the package cost.
  • TCS certificates will be issued to the user for claiming credit while filing tax returns.

Compliance with TCS requirements is mandatory.

11. Compliance with Liberalized Remittance Scheme (LRS)

When booking international travel services, users must comply with India's LRS guidelines under the FEMA Act.

You may be required to submit PAN details, A2 forms, or other declarations.

Travdif is not responsible for penalties arising due to non-compliance with LRS rules by the user.

12. Right to Refuse

Travdif reserves the right to deny services to any individual if:

  • False information is provided.
  • Behavior is abusive, unsafe, or harmful.
  • Payment issues arise.
  • Activities that disrupt the experience for other travelers or local communities are observed.

Such refusal will be at the sole discretion of Travdif without refund.

13. Right to Cancel

Travdif reserves the right to cancel trips under circumstances including but not limited to:

  • Natural calamities
  • Political unrest
  • Health emergencies
  • Operational constraints
  • Failure to meet minimum group size (if applicable)

In such cases:

  • Travdif will offer alternative trip dates or full refund.
  • Compensation for other related losses (e.g., visa fees, insurance, flight costs) is not guaranteed.

14. Fake Calls, Phishing, and Fraudulent Activities

Beware of fake calls, SMSs, emails impersonating Travdif requesting personal financial information.

Travdif will never ask for sensitive information (CVV, OTPs, passwords) through unsecured communication.

If you receive suspicious communications, report immediately to: support@travdif.com.

Travdif disclaims liability for losses arising due to user negligence in such fraud cases.

15. Indemnification

You agree to defend, indemnify, and hold harmless Travdif and its employees, partners, and affiliates against:

  • Claims, liabilities, damages, losses, and expenses arising out of your breach of these Terms.
  • Any violation of law or third-party rights.
  • Misuse of the Travdif platform or services.

This obligation will survive the termination of these Terms and your use of Travdif’s services.

16. COVID-19 Related Terms & Conditions

Due to evolving health advisories and government mandates:

  • You agree to comply with mask mandates, social distancing, vaccination requirements, and any health checks as needed.
  • Travdif reserves the right to deny participation without refund if you fail to meet COVID-19 protocols.
  • Cancellations due to travel bans, health emergencies, or positive tests will follow standard cancellation policies.

Travdif is not liable for any COVID-19 infection or health complications arising during or after the trip.

17. UPI Related Terms & Conditions

  • Payments through UPI must be done using verified and trusted payment platforms.
  • Users are responsible for ensuring correct UPI IDs and transaction details.
  • Travdif will not be liable for failed or incorrect transactions made via third-party apps.

18. System Usage

Users agree to:

  • Refrain from introducing malware, viruses, or harmful code.
  • Not disrupt, overload, or attack the Travdif website or servers.
  • Not attempt unauthorized access to other users’ data or Travdif’s confidential systems.

Violations may result in legal action under applicable cyber laws.

19. Miscellaneous

  • These Terms are governed by the laws of India.
  • Any disputes will be subject to the exclusive jurisdiction of the courts of [Insert your City].
  • If any provision of these Terms is found invalid, the remaining provisions will continue to be valid and enforceable.
  • These Terms constitute the entire agreement between you and Travdif regarding the use of our services.
